1. Acceptance of Terms
By accessing or using Bopbee ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may change these Terms at any time by posting an updated version on our website. Your continued use after changes take effect means you accept the revised Terms.
2. Eligibility
The Service is available only to individuals and organizations that can form legally binding contracts under applicable law. By using the Service, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and not barred from using the Service under applicable law. If you accept these Terms on behalf of a company, you represent that you have authority to bind that company.
3. Description of Service
Bopbee is a public hosting platform. The Service lets you upload files and publish them via unique HTTPS links. We may modify or discontinue features at any time. We reserve the right to refuse, hold, or remove any content that we consider inappropriate for a public website.
4. User Responsibilities
You agree to:
- • Provide accurate information when creating an account
- • Keep your account credentials secure and notify us of unauthorized use
- • Publish only content you have the right to share
- • Back up your own files; we do not guarantee recovery of lost User Content
- • Not use the Service for spam, scams, or malicious purposes
- • Comply with all applicable laws and regulations
5. Public Access to Deployments
Unless otherwise stated in the product, deployments are public on the internet. Each deployment receives a public HTTPS link. Anyone with the URL may access it. You are responsible for what you publish and for sharing links only with people you intend to reach.
6. Prohibited Content
You may not publish content that is illegal or harmful, including but not limited to:
- • Illegal content or content promoting illegal activities
- • Drugs, controlled substances, or instructions to obtain them
- • Weapons, explosives, or instructions to build or obtain them
- • Pornographic or sexually explicit material
- • Content that incites violence, hatred, or harassment
- • Scams, phishing, fraud, or malware
- • Any content intended to deceive, harm, or endanger others
- • Content that infringes intellectual property rights
This list is not exhaustive. We may remove or refuse any content we consider inappropriate for a public website.
7. Content Moderation and Review
Bopbee automatically scans uploads before publication. If something looks suspicious or violates this policy, your deployment may be held for manual review.
- • Your upload succeeds and is stored securely.
- • The public link is not activated until our team approves the content.
- • Your previous live version (if any) stays online until the new one is approved.
- • You will see a "Pending review" status on the deployment page.
- • Reviews usually happen within a few hours during business days.
If we reject a deployment, the public link will not be activated and the status will show "Rejected". You may contact us via chat if you believe the decision was a mistake. Repeated violations may result in account suspension or termination.
8. Intellectual Property
You retain ownership of content you upload. By uploading, you grant Bopbee a non-exclusive, worldwide license to host, store, display, distribute, and review your content as necessary to provide the Service and enforce these Terms.
9. Accounts, Security, and Data
You are responsible for all activity under your account. We use service providers that may process data outside your country. By using the Service, you consent to such processing. We use commercially reasonable efforts to keep the Service available, but we do not guarantee uninterrupted access and are not liable for downtime, maintenance, or events beyond our reasonable control.
10. Paid Subscriptions and Billing
Paid plans are billed in advance through our payment provider (currently Stripe). Prices, features, and limits are shown at checkout and may change for new purchases. Taxes may apply depending on your location. By subscribing, you authorize recurring charges until you cancel. Failed payments may suspend paid features. Switching between monthly and yearly billing or between plans is handled in your account and may be prorated by our payment provider according to its rules, not as a refund.
11. 7-Day Money-Back Guarantee and Refunds
We offer a 7-day money-back guarantee on your first paid subscription, consistent with our pricing page. This section explains when a refund is available and when it is not.
- • Eligibility: Request a refund within 7 calendar days of your first successful charge for a paid plan (Solo, Pro, or Studio), using the email on your Bopbee account.
- • How to request: Contact us at [email protected] with your account email and a brief explanation. We may ask reasonable questions to process your request.
- • If approved: We refund the amount paid for that first billing period to your original payment method, cancel the paid subscription, and downgrade your account to Starter. Processing usually takes 5 to 10 business days; banks and card issuers may take longer.
- • Not eligible: Subscription renewals; plan upgrades or downgrades after the first payment; any second refund request; accounts linked to a customer who already received a guarantee refund; suspended or terminated accounts; fees or taxes we cannot recover from our payment provider; reseller, voucher, or custom/enterprise deals unless agreed in writing.
- • After 7 days: Except where mandatory consumer law requires otherwise, all charges are final. Canceling stops future billing but does not refund the current or any past period.
- • No partial refunds: We do not refund unused time, downgrades, or unused features after the guarantee period.
- • Chargebacks: Contact us before filing a bank chargeback. Abusive or fraudulent chargebacks may lead to immediate suspension or termination, and you remain responsible for related fees and costs.
- • EU/EEA consumers: Where law gives you a withdrawal right for digital services, you may lose that right once you start using paid features at your request, as permitted by law. Where a mandatory cooling-off period still applies, our 7-day guarantee covers eligible first-time purchases for at least that period.
Refund decisions under this guarantee are made in good faith but remain at our discretion when we detect abuse, fraud, duplicate accounts, or Terms violations. Nothing in this section limits rights that cannot be waived under mandatory consumer law.
12. Subscription Cancellation
You may cancel a paid subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period unless we approve an eligible refund under Section 11. After cancellation, paid features remain until that period ends, then your account reverts to Starter limits.
13. Spam, Abuse, and Enforcement
We do not tolerate spam, phishing, malware distribution, or abusive traffic. We may suspend or terminate accounts, remove content, or block access without prior notice when we believe you violated these Terms, applicable law, or our content policy, or to protect the platform and other users. You may delete your account at any time.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT MODERATION WILL DETECT EVERY VIOLATION. NO ADVICE FROM OUR SUPPORT TEAM CREATES A WARRANTY.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOPBEE AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO BOPBEE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100. ANY CLAIM MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER IT ARISES. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
16. Indemnification
You agree to defend, indemnify, and hold harmless Bopbee and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party right.
17. Changes to Terms
We may update these Terms from time to time. We will post the new version and update the "Last updated" date. Material changes may also be communicated by email or in-product notice where appropriate. Continued use after the effective date constitutes acceptance.
18. Governing Law and Disputes
These Terms are governed by the laws of France, without regard to conflict-of-law rules, except that mandatory consumer protections in your country of residence still apply where required. Courts in Paris, France have exclusive jurisdiction for business users and where permitted for consumers; consumers in the EU may also bring claims in their country of residence where law allows.
